Please read these Terms carefully. By accessing or using any website or digital service powered by the Sophia platform, you agree to be bound by these Terms of Service. If you do not agree, please do not use the service.
1. ABOUT THESE TERMS
These Terms of Service ("Terms") govern your use of websites, mobile applications, and related digital services ("Services") operated by retail businesses ("Retailers") that use the Sophia platform ("Sophia", "we", "us", or "our").
These Terms apply to your use of the Sophia privacy portal and any Retailer-branded interfaces powered by Sophia. Separate terms may apply to your purchases from individual Retailers — please review each Retailer's own terms and conditions.
2. USE OF THE PRIVACY PORTAL
The Sophia privacy portal is provided solely for the purpose of submitting data subject requests (access, deletion, correction, portability, and opt-out requests) in accordance with applicable US state privacy laws and our Privacy Policy.
Permitted use
- Submit genuine data requests about your own personal information
- Submit requests as an authorised agent with proper authorisation from the data subject
- Review information about your privacy rights
Prohibited use
You may not use the portal to:
- Submit requests on behalf of another person without their authorisation
- Provide false or misleading information in a data request
- Attempt to access data belonging to another individual
- Conduct automated scraping, crawling, or systematic data collection
- Interfere with or disrupt the portal or its underlying infrastructure
- Use the portal for any unlawful purpose
3. IDENTITY VERIFICATION
To protect the security of personal information, we are required by law to verify your identity before fulfilling data requests. You agree to provide accurate identifying information and to cooperate with reasonable verification procedures, which may include responding to a one-time email verification code.
Submitting a data request with intentionally false identifying information may constitute fraud and could expose you to civil or criminal liability.
4. INTELLECTUAL PROPERTY
The Sophia platform, including its design, software, content, trademarks, and logos, is owned by Sophia and is protected by US and international intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Sophia platform beyond the limited right to use the portal as described herein.
The name "Sophia" is a trademark of Sophia. You may not use these marks without prior written permission.
5. DISCLAIMERS
THE SOPHIA PRIVACY PORTAL IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the portal will be uninterrupted, error-free, or free of viruses or other harmful components. We reserve the right to suspend or discontinue the portal at any time without notice.
The information on this portal, including descriptions of your privacy rights, is provided for informational purposes only and does not constitute legal advice. For legal advice regarding your specific circumstances, please consult a qualified attorney.
6. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SOPHIA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SOPHIA PRIVACY PORTAL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total liability to you for any claim arising out of or relating to these Terms or the portal shall not exceed USD $100.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitation may not apply to you.
7. INDEMNIFICATION
You agree to indemnify and hold harmless Sophia and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the portal in violation of these Terms; (b) your submission of false or misleading information in a data request; or (c) your violation of any applicable law or regulation.
8. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or the portal that cannot be resolved through good-faith negotiation shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA), conducted in English in the State of Delaware. The arbitration decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Notwithstanding the above, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration.
Class action waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
9. CHANGES TO THESE TERMS
We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date above and, where appropriate, by posting a notice on the portal. Your continued use of the portal after changes take effect constitutes your acceptance of the revised Terms.
